Colonial Heritage Key Governing Documents

  1. Declaration of Covenants, Conditions, Restrictions and Reservation of Easements – This is the primary document that establishes the community, often referred to simply as “the Declaration.” It creates the foundation for the community’s legal structure and rules as referenced throughout the Bylaws document.
  2. Articles of Incorporation – This document establishes Colonial Heritage Homeowners Association, Inc. as a legal entity in Virginia and is referenced in the Bylaws as defining the Association’s classes of membership and other foundational aspects.
  3. Bylaws – These govern the operation of the Association, including meetings, voting procedures, powers and duties of the Board of Directors, officers and their duties, finances, and other operational aspects.
  4. Architectural Review and Covenants Committee (ARCC) Guidelines – This appears in multiple documents and governs the architectural standards and approval processes. According to the ARCC Charter, this committee advises the Board of Directors “as to the external design, appearance and modification of the Lots and Structures” to enforce architectural provisions and preserve property values.
  5. General Committee Guidelines – This document establishes guidelines for standing and Ad Hoc Committees of the Board and encourages “the broadest possible representation of residents in the planning and decision-making processes of the community”.
  6. Membership Plan – Referenced in the Bylaws as the “Plan for the Offering of Memberships and Rules and Regulations of the Association pertaining to Social Members and Golf Members”.
  7. Rules and Regulations – These are more specific operational rules that can be adopted and amended by the Board of Directors as mentioned in the Bylaws under the powers of the Board to “adopt, publish and amend rules and regulations”.

The community is governed through a homeowners association officially named Colonial Heritage Homeowners Association, Inc., which does business as “The Colonial Heritage Club”
